New AI Transparency Mandates Take Effect Across the EU

The European Union has implemented new transparency obligations concerning artificial intelligence, which became enforceable across the entire bloc on August 2nd. These regulations are designed to enhance user awareness regarding interactions with AI systems and content generated by artificial intelligence.

Core Requirements Under the Landmark AI Act

Article 50 of the EU’s seminal AI Act mandates that content publishers and developers must now:

  • Clearly label and disclose specific types of AI-generated content.
  • Inform users when they are engaging with a chatbot or AI agent rather than a human individual.

The objective of these provisions is to empower individuals to more easily identify chatbots and AI deepfakes online. Failure to adhere to these new requirements could result in substantial penalties, with fines reaching up to €15 million.
